1. The Service

AI Foto is an AI-based image generation service that lets you create images from text prompts or uploaded reference images. We may improve, change, or discontinue features at any time.

2. Accounts

You register via our third-party authentication (Clerk). You are responsible for safeguarding your account and for all activity under it.

You must provide accurate information and be of legal age to use the service in your jurisdiction.

3. Acceptable Use

You may not use the service to generate or upload content that is illegal, infringing, violent, hateful, sexual, deceptive, or that violates others’ privacy or likeness rights.

You may not abuse the service, including automated bulk requests, bypassing quota limits, or attacking or disrupting normal operation.

Reference images you upload must be ones you have the legal right to use. You are solely responsible for any disputes arising from content you upload.

4. Generated Content & IP

Subject to these terms, you may use the images you generate for personal or commercial purposes.

You are responsible for the legality of your prompts, uploaded materials, and use of the results.

AI-generated content may resemble others’ results; we do not guarantee uniqueness and are not responsible for how it is used.

5. Subscriptions & Billing

Free users share a limited generation quota (currently 12). Pro offers unlimited generations, billed monthly ($15/mo) or yearly ($120/yr).

Subscriptions are processed by PayPal and auto-renew each billing period until you cancel.

You may cancel anytime in PayPal; after cancellation you keep Pro until the end of the current paid period.

Except where required by applicable law, paid fees are generally non-refundable. Contact us with any questions.

6. Disclaimers

The service is provided "as is". We do not guarantee uninterrupted or error-free service, nor that results will meet your specific expectations.

AI models are provided by third parties and their availability and quality may change.

7. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of or inability to use the service.

8. Termination

We may suspend or terminate your account if you violate these terms. You may also stop using the service at any time and contact us to delete your account.

9. Changes to These Terms

We may update these terms from time to time and will revise the "Last updated" date above. Continued use means you accept the updated terms.
